PHOTOSHOOT TERMS 

General:

1. Each reservation requires a deposit of €50, which is payable after reading and accepting these terms and conditions to the bank account: Ohhmels NL56 INGB 0675 9387 59 or PayPal account: pamelaskrzynska@gmail.com; description of your payment should be: [TITLE - DATE, example: FLYING DRESS - 01.01.2024]

2. The photographer agrees not to advertise the availability of the same date to other potential clients. If the client cancels the session or does not show up for the scheduled appointment, the initial payment will not be refunded to the client.

3. Each client is entitled to a one-time right to change the date of the photo session within a week of the reserved date, for valid reasons such as illness, no later than 48 hours before the planned photo session, at no additional cost.

4. The remaining balance for the photography services must be paid in full on the day of the photo session in cash or at least 24 hours before the start of the session via bank transfer.
    

Deliverables:

1. The photographer will provide the client with an online gallery within (a maximum of) 4 weeks after the photo session.

2. After selecting photos from the gallery, the photographer must deliver the selected photos within one week after the client places the final order.

3. The photos in the online gallery are subject to basic color correction. The final effect in the highest quality, along with retouching and advanced color editing, will be delivered to the client after placing the order.

4. The client may select additional photos from the online gallery - €15/photo.
    

Copyright and Usage:

1. The photographer retains the copyright to the photos. The client receives a license for personal use and cannot sell them to third parties without the photographer's written consent.

2. The client agrees that the photos will not be altered, edited, or distorted in any way during their use.
    

Liability:

1. The photographer will make every effort to provide services in accordance with the agreement. However, the photographer reserves the right, in exceptional cases such as an illness, or equipment failure, to reschedule the session. The client will be notified at least 48 hours before the planned session and has the right to choose a new date within 2 weeks at no additional cost.

2. The client agrees to indemnify and hold the photographer harmless from any claims, damages, and costs resulting from the client's use of the photos.

3. Third-Party Services: If any third-party services (e.g., makeup artists, videographers) are coordinated by the photographer, the photographer is not responsible for the actions, results, or consequences of those third-party services.

4. Outdoor sessions are rescheduled if the weather predicts rain or strong wind.
    

Model Release:

1. The client grants the photographer unlimited rights to use and publish photos taken during the session for editorial purposes on social media (@picturedbymels) in any way, including on websites and other digital media. This right includes the possibility of editing, altering, or combining photos with others, with or without the client's knowledge.

2. The photographer may not sell photos containing the client's likeness to third parties without the client's written consent.

3. The client has the right to purchase an additional option (for €50) called a "secret photoshoot," where the results of the session cannot appear on any social media, the photographer's portfolio, or other digital media.
